Nov. 5, 2013 By Christian Murray

Two Sunnyside residents were found dead in their apartment by the police this morning.

Residents of the apartment building–located at 43-33 46th Street–called the police after smelling a foul odor from one of the apartments.

Upon arrival, the police discovered the bodies of two residents–located in a first floor apartment–who had most likely died three days to a week prior.

The deceased were identified as Diana Rodriguez, 47, and Kevin Flannelly, 59.

There was no apparent trauma to either victim. The Medical Examiner’s will be determining the cause of death.

To “this isn’t Facebook”…I really hope when your family member passes away you are shown the same compassion you have bestowed upon me. I can’t tell you how overjoyed my family and I were with the Sunnyside Post prompting the NY Post to call my sister in Florida who has a whole two hours to deal with the passing of our sister.

To Susana and other bashing inquiring minds (IM)… although condolences to you, IM is asking a very to-the-point question BECAUSE sunnyside post is an online newspaper. It would be different if this were facebook and this news was private to friends and family, but it isn’t — it is part of the public record and the coroners report, when it comes out will be public as well.

Susana, I don’t know how to contact you to let you know how sorry I am for your loss. I’ve thought of Diana often over the years and I can’t believe what I just learned. I remember the beautiful side of Diana. She had a huge heart and I know she loved you as well as Lizette. You, Diana and your family are in my prayers.

Hi Mark, I don’t know if you will ever get this – it’d rita – remember me? I was Diana’s friend from the gym years ago. We went to the beach once – all of us. I just now learned of Diana’s death. Three years later. I always wondered whatever happened to her. I’m devastated and heartbroken. Please respond

Drugs are present everywhere! They have been here in our precious Sunnyside for years! Why is this news? Why do people show such hatred? Drugs take people’s lives, in more ways than one. A societal problem with few solutions. Start brainstorming and be the change you wish to see in your community.

Rest peacefully Diana and Kevin. There but for the grace of God go I. Judge not.

Why is somebody writing completely in caps? My eyes hurt! Drug addiction is a terrible disease and addicts are frequently violent – to themselves and others. And yes, there is drug dealing in Sunnyside/Woodside even in the gardens. Open up your eyes! An the Mets Houses for years has had a problem.

@ Nostradamus – you are a clown. I grew up here & I still adore my neighborhood. I don’t do drugs & if I had an addict in my family, I would not enable them. Let them hit rock bottom. I would much rather the hipsters moving into the neighborhood & let’s start shuffling the drug addicts out. If you have law enforcement in the family, you might know more too. Go to the community board meetings & get crime stats. Do research to find out who certain people are. If you don’t notice the undercover police in unmarked cars, patrolling the area, you are more than a clown – you’re a dummy. Put a surveillance camera with a 24/7 feed on the street level of your home and you would be amazed with what you see. By the way, you sound like that other poster Ruben and if you’re not him, you are just an angry person in general. Go see a shrink.

Rest in peace Kevin and Diana.kevin was a decent guy whose mother was a lady. She died a couple of years ago so thankfully she is not around to see what happened to her son. Kevin was an excellent painter and worked very hard when he was younger. He got caught up in the drug world and unfortunately was never able to quit. Sunnyside has always been the home to drug dealers. The people who have lived here for quite a while knows this but the 108th seems to turn a blind to this. I feel sorry for the person who was slashed by Diana but normally birds of a feather flock together. Why doesn’t everyone who submits comments to this site go to the community meetings and voice your opinions there instead of complaining constantly on this site??? Too lazy or just don’t really give a dam???rest in peace Kevin. Hope you have finally found peace.

Jocelyn, it seems you know a little too much about “the new trends” occurring in the neighborhood, more than most normal people would at least.
How would you have all this ‘knowledge’ if you are not involved/enabling those who take part in these illegal activities? Or participating in them yourself???

YOU SPEAK SO STUPIDLY. AS IF ANYONE COULD THROW A ROCK IN ANY DIRECTION AND FIND PRESCRIPTION DRUGS “XANAX AND OXYCODONE” IN A PARTICULAR SET OF BLOCKS HAHAHA YOU MAKE ME LAUGH, I GUESS IT’S TRUE WHAT THEY SAY, IGNORANCE IS TRULEY BLISS.

WHAT ABOUT THE DOCTORS WRITING THESE PHONY PRESCRIPTIONS WHILE PEOPLE WHO REALLY NEED THEM ARE FORCED TO EITHER GO WITHOUT AND SUFFER OR GO LOOKING FOR THEM ON THE STREETS AND RISK ARREST AND BEING ROBBED?

WHAT ABOUT THE PHARMACEUTICAL COMPANIES MANUFACTURING THESE DRUGS KNOWING THEY WILL BE ABUSED AND LEAD MANY TO ADDICTION

WHAT ABOUT THE PHARMACIES HANDING OUT THESE DRUGS KNOWING THAT MORE THAN HALF OF THEM WILL EITHER BE SOLD OFF/TRADED AWAY AND THAT THE OTHER HALF WILL CAUSE MANY TO BECOME ADDICTED TO SAID DRUGS AND WHEN THEY CANT GET THEM FROM THE DOCTORS OR PHARMACY ANYMORE; THEY GO LOOKING ON THE STREETS TO RELIEVE THEIR PAINS AND ILLNESSES

AND THE BEST PART ABOUT IT IS THAT THROUGH OUT THIS ENTIRE PROCESS THE HUGE COMPANIES WILL BE PAID, THE PHARMACIES WILL BE PAID, THE PEOPLE WHO SELL THEIR MEDICATIONS WILL BE PAID, THE DRUG DEALERS WILL BE PAID, AND LAST BUT NOT LEAST THE LAW ENFORCEMENT DIRTY OR CLEAN, TO ARREST THE OFFENDERS WHO GET CAUGHT WILL MOST DEFINITELY BE PAID BY THE CITY AND TO WHOEVER THEY SELL THE CONFISCATED DRUGS TO AFTERWARDS

OH AND DONT FORGET ABOUT THE HOSPITALS THEY WILL BE PAID TO SAVE THOSE WHO OVERDOSE IN THIS HORRIBLE CIRCLE OF LIFE,DEATH,DESTRUCTION AND DESPAIR WE CALL SUNNYSIDE

F*** ALL YOU BOOSHIE HIPSTER MOTHERF****** WHO THINK YOUR BETTER THAN THE NEXT CAUSE YOU ARE JUST AS BAD IF NOT WORSE.
DRINK YOUR WINE AND EAT YOUR CHEESE AND SHUT THE F*** UP BECAUSE YOU KNOW NOTHING OF WHAT GOES ON IN THE WORLD, AND NEITHER DO I BUT THE ONLY DIFFERENCE IS I DONT TRY TO ACT LIKE I DO.

46th & 47th Streets on both sides of the boulevard are riddled with drug sales, drug addicts & the new trend is the sale and/or swap of prescription pills. Xanax & Oxycodone is huge in this neighborhood right now. Diana Rodriguez & her crew, along with the crack house (apartment) on 44th Street has been on the 108’s radar for quite some time. We need the 108 to step up patrols in the neighborhood. I understand that drugs is an addiction, but the illegal activities by these individuals should not intrude upon the lives of others. Agree with a prior commenter, please attend our community board meeting & make your voice heard!

To all of you defending survivor there is always two sides of the story. So you probably just heard the one side. True no one should be physically injured but enough is enough about survivor. Who really cares. This is not about her. Its about the death of two humans. Even if you think they were not the best people on this earth. Everyone makes mistakes. Look in your backyard before you throw the first stone. I am sure that many of you commenting on Diana and Kevin’s behaviour and drug addiction were the first ones knocking at their door and partying with them when you needed a fix pretending that you were their best friend. Enough is enough don’t judge a person by their behaviour when they are under the influence of alcohol or on drugs that person you see is not the person who they really are.

To: Survivor all these so call people mentioning your incident with Diana are going to be the first to write bad things about you when your time comes open your eyes and get on with your life.

LET DIANA AND KEVIN REST IN PEACE.

@Lisa If you read the thread correctly The only reason I had something to say to survivor is because I said Diana had a good heart and Chris didn’t agree and brought up a situation that occurred something like a decade ago and made these comments something that it is not. It is sad to see the hateful comments that are being written but you didn’t know the real Diana. Diana was a beautiful person inside and out. She was funny; she was caring and most of all she was the type of person that would have done anything for anyone. She did have a beautiful heart. She was my best friend and we were like sisters.

I am not condoning her bad behavior but she did have emotional problems and unfortunately got lost in the world of drugs. Diana didn’t want this lifestyle but couldn’t extricate herself from this world. Unfortunately, I lost her many years ago and now I lost her again. She is finally at peace. Her struggles with her demons have finally come to an end.

@Family. I am sorry for your loss, but you are showing your lack of class. Again, Survivor responded because her story and person was being mentioned. For you to make a statement that shows acceptance of another person physically assaulting someone because of their mouth shows a lack of respect and class. Also, consider the mental damage that an attack like that must have on a person. There was a fire in one of the buildings that I lived in 10 years ago, and I still panic when I smell smoke or hear an alarm. And that is nothing compared to being physically assaulted as survivor was. Your cousin obviously had two very extreme sides. You can’t expect everyone to have kind words to say about her even now that she is deceased. If you don’t want to hear what both sides have to say, then don’t read or listen to comments. AGAIN, it is important to respect the living and not just the dead. This tabou of not speaking ill of the dead is ridiculous. I would hope we are all aware that some people have kind words to say about us and some may not. It depends on the experiences we had together. Those kind and not so kind words will be said in our lives and in our death.

The fact that anyone is attacking survivor is ridiculous. If you look back at the thread, she only responded because the people on the thread mentioned her. By the way, this is a thread about a news article and not the services for the deceased, to mention things other than RIP is not out of line. Many of you are so worried about respecting the dead with no regard for the living. Peoples lives were affected by these people (negatively and positively), you have to deal with both sides. It’s good to see that some have had very positive experiences with them, but there are many (like survivor) who have had horrible ones. Deal with it!!

I knew Diana many years ago when she was young, beautiful, and had not taken this path. I am heartbroken to see the turn her life took and the destruction of self inflicted woulds which lead to wounding others. She was a girl once, innocent and sweet. She was hurt by life and never could cope and chose to self medicate and destroy all the beauty and love that was within her. She always used to go to church back then and cry. I believe that God is merciful and she is resting in peace. I believe God honored every tear she shed to him, every candle she lit, every shout for help she let out in her deepest time of sorrow. She self-medicated but I bet she never, ever stopped crying out to God. She just couldn’t accept the peace God offered and she could not open herself up to be healed from the pain she kept so deeply buried within herself. We all have the freedom to chose and she made the wrong choices which ultimately ended her life. I am so sorry that there are so many who can write such horrible things about her based on what she became. I will remember the sweet Diana I knew. I was always sad I lost her years ago and now I am saddened even more that she lost her life.
My deepest sympathy to her parents and her sisters. Rest in Peace old friend.

Luckily, he takes his meds daily & lives a happy, productive life. It sounds like your Sister’s situation was far worse. I hope Diana & Kevin are at peace. Can I make a suggestion: If you have a wake or funeral for Diana, please be aware of the crack head crew that is going to descend upon the funeral home. The survivor was clearly able to turn her life around and no longer participates in the very activities that PROBABLY took Diana & Kevin’s life. It doesn’t really matter what ‘wbsunside’ wtinessed and obvioulsy he/she partied with the two of you as well. @ wbsunside:

I was involved with that pathetic crew for three years after suffering over the loss of my mother. My involvement with that group of people and the drugs that were available was a horror I will never repeat.

I am not perfect. However, I learned, got off of drugs and have moved on with my life. Diana was a violent person. She assaulted quite a few people, not just me. Diana was not willing or able to rise above and get out of that world.

Your low class, sociopathic choice to lash out at a victim of a violent crime speaks volumes about the type of character you possess and the person you are.

@ Maddie – sorry to disappoint you but not everybody is addicted to something or has a vice as you say. Maybe I lead a very boring life, but I have NEVER smoked cigarettes, I do NOT do drugs and I have an occasional libation maybe three times per year. Sorry if this sounds like a boring life to some of you. I am a responsible, tax paying member of society and a long time upstanding member of this community. I can’t speak for Kevin, but Diana did drugs (hard core) and accosted somebody. Legally, you are not allowed to do that. You cannot put your hands on another human being! Do you people get that? Sorry that she had problems, but most people do have some sort of problem and that DOES NOT give you the right to harm another individual. Just because she was a junkie does not give her a hall pass to ruin the lives of other people. We need to stop giving the excuse, “Oh he/she was into drugs at the time, so that’s why that happened.” My personal belief is that because Kevin had a family member who was either retired or active NYPD, which is why Diana was offered a plea bargain.

@ Susan Parker – I believe I know who you are too. It is amazing how much empathy you have for Diana, but NONE for the woman who Diana slashed in the face with glass. That is pathetic. All I can say is that I will continue to attend community board meetings and assist the NYPD on drug activity in the neighborhood & hopefully try to rid the neighborhood of such individuals. The rest of us deserve to live in peace and quiet.

@Susan Parker. You do NOT know what you speak of!!!!! I saw photos of the victim’s face after being in the hospital and there were significant wounds! The small scar was after a year of healing. Susan, you are a monster if you think it is minimal to do something like that to another human being. I understand that the two of them suffered and that is what led them to live the lives that they did, but that does not excuse the damage they did to others. I do hope they are in peace. But again Susan, you minimizing an assault on another human being is disgusting! Maybe if someone shattered glass into your face you would understand, but probably not.

@Susan Parker – ” Mountain out of a mole hill” ? That kind if response is to be expected from a supporter of the Sunnyside Crackhead Crew. Yours is a world where it is acceptable to harm one another.

I’d like to thank the New York State Crime Victims Fund for paying the $6,000.00 dollars it took to put my face back together, after the violent assault. Though the few small physical scars that remain are a reminder of just how violent people can be.

Diana and Kevin were tormented individuals and at least now they can no longer harm themselves or anyone else.

Susan, I am sorry for your loss.

Everyone else, your lack of tact and ignorance are abhorrible. If these two residents passed as a result of substance abuse it is far more likely that this was a result of using after an attempted detox or sustained absence from the drug. As a former IV heroine addict, 12 years off, relapses are far more common a cause of overdose than foul play or foolishness.

@Sunnyside Native: the discussion a few months ago was about someone saying that drugs were being sold on corners on 48th avenue and I said that was nonsense. Having lived by 48th for for over 15 years and having used it quite frequently, I knew that was not true. After going back and forth, the original poster amended the post, saying drugs were sold openly “back in the nineties.” Thios person claimed to live over on the north side now and reported that there were drugs being used over there.

Now I have no doubt that there are addicts living in our neighborhood- it’s understandable. I never claimed there weren’t. But I doubt that drugs are being sold out on the street these days. It was the implication that lawlessness existed in this area, which wasn’t true.

Hey Chris I know your friend with her slashed face and i think i know who u r 2. Diana had emotional problems as well as a drug problem, however she was a human being. As for your friend and the tiny little scar on her nose no bigger than a pimple is a straight up drama queen and has caused her share of trouble in this neighborhood. So whatever happen to love your neighbor and forgiveness. This is a terrible time for the relatives why dont u find something else to do.

@ Willy – please do some research and know the difference between to/two/too and their/there. Also, after reading about how Diana assaulted somebody (above), YES, most people have problems: sick child, no job, elderly parent with dementia, drugs as in this case and we do not go around assaulting people despite having our own personal problems!!!

Obituaries are not news, they’re death notices.

Newspapers have a special section for obituaries, separate from the news content, precisely because they are not news items.

If Sunnyside post (which I really enjoy) starts reporting on the deaths of all the Sunnyside residents, suspicious and natural, this may turn into a tough read.

Diana didn’t have a good heart the day she attached my friend, and used a sharp piece of glass to cut her in the face. She had to have some facial surgery to repair the damage did. Diana was arrested, but took a plea bargain and was back on the streets in no time. Couldn’t even sue her civilly because she was a drug addict who had nothing, other than I presume welfare & food stamps. The mental and emotional suffering that my friend went through for what Diana did to her was unimaginable. I don’t want to hear about a ‘good heart’.

Willy — my own back yard is clean. That’s a fact.
The residents of 46th stret and Sunnyside are safer with them gone.
That is a fact. Spare us your anger and condescension.

These deaths took place in Sunnyside. Why wouldn’t it be a relevant story for a blog about Sunnyside?

Those two junkies were a stain on the neighborhood. They stole from, hurt and terrorized many people over the years. Glad they are gone.

Christian is not speculating as to how these two individuals died. He is merely reporting the initial part of this story. This is very sad. These two were ‘running buddies’ in the drug world that takes place in Sunnyside. I have asked about them to others in the past, as I have seen them before. Diana was no stranger to the 108 Precinct. I believe that was Kevin’s apartment and Diana just crashed there. I thought I heard Kevin’s brother was either active or retired NYPD, but maybe I am wrong about that. Hopefully the ME will get to the bottom of their death soon. I am personally speculating that it was either an overdose or a bad batch of dope. Thank you to Christian for posting this story. If there is a death within Sunnyside, I do want to know about it. Everybody should attend the community board meetings and meet the Captain of the 108 and learn about the ‘goings-on’ in your neighborhood. May Diana & Kevin finally RIP…

This is just a news forum for things that happen in sunnyside. And yes, this may not be a big news item that affects anyone else, but it is still news nonethless. Don’t like it, just don’t read it. I don’t see what some of your problems are.

As sad as those people’s deaths are, I agree with Webley and Hal and hope Sunnyside Post doesn’t start speculating on stories that could happen anywhere and that have nothing to do inherently with Sunnyside.

Perhaps the Blue Bloods detectives will work on this case…..

Seriously though, I’ll speculate and say it was an overdose.

I categorically agree with Webely. Tragic as it may be, how is it actually relevant to Sunnysiders?

I doubt it was carbon monoxide , had it been CO2 it would have kept saturating the room and extend to surrounding rooms and areas.

Guys, this is the internet. If we can’t make jokes about death and real estate then what are we doing here? Lighten up.

Coming from a person living two blocks away.

RIP.

I didn’t know we had so many CS investigators on this site, commenting out of their butts, have some respect. Hopefully blog owner follows and posts the results of the medical examiner report, and honestly, unless there is foul play, I don’t see the point of posting this particular article. When the results become available and there is criminality suspected, then editor can go ahead and post.

I walk around neighborhood and I see tons of things to report, the other day I saw a large Ford SUV with a brick smashed through its wind shield, this was never reported here. I see weird road construction that never seems to end throughout the neighborhood, nothing ever gets reported on that. There are more things to report such as renovations to stores, deals that can be found throughout the neighborhood, etc.. I guess this blog ignores businesses and other establishments unless they pay for advertisement.

It was my sister and she had problems and would appreciate you reslecting the families and not speculate.

I saw the ME van parked on 46th Street earlier & that’s never a good sign. I told Super Witty Smitty twice over the past couple of months which blocks on both the north & south side had drugs going on them. These two were drug addicts for YEARS, along with a handful of other neighborhood junkies. Sad to see two people die like this, but maybe they are at peace now.

God grant them both eternal rest.

And, please, don’t speak ill of the dead. They can not speak to defend themselves.

Do they think it was CO poisoning or something? This is really terrible (and strange that they both died at the same time).

Hal

I gonna consult with a realtor about getting me into that apartment.. It’s nice up there on the north side…

Hal

It it’s a pre war building, the the body fluids would have leaked to the unit below. Not very pretty. That being said, I hope the heat was not on.

The New York City Council passed a landmark bill on Wednesday, aiming to relieve renters of paying hefty broker fees — a cost that will now fall on the party who hires the listing agent. Known as the FARE Act (Fairness in Apartment Rentals), the legislation passed with a veto-proof majority of 42-8, despite opposition from Republicans and conservative Democrats.
