An East Elmhurst man has been sentenced to 23 years in prison for sexually assaulting a young girl over a three-year period while he was her babysitter.

Jose Nivelo, 43, was sentenced Tuesday having been found guilty by a jury of child sex crimes in June for the abuse that started in 2012 and took place for three years.

According to the charges, Nivelo began babysitting the girl more than a decade ago at his then home on Hampton Street in Elmhurst. He would pick her up from school and look after her while the girl’s mother was at work.

In April 2012, he began sexually assaulting her inside his home when she was age 7, authorities said. Nivelo, according to court records, groped her and had her undress in front of him on numerous occasions.

He then escalated his abuse soon after she turned 8-years-old, when he also engaged the victim in acts of anal and oral sexual conduct. By that time, Nivelo had moved to an address on 97th Street in East Elmhurst, prosecutors said.

“Instead of providing safe care for this young girl while her mother worked, the defendant has brought unimaginable trauma and pain to the victim by sexually abusing her for years,” said Queens District Attorney Melinda Katz said.

“The protection of our children is paramount and has remained a top priority throughout my entire career in public service. The defendant will now serve a lengthy prison term for his despicable actions.”

Nivelo’s prison term will also be followed by 15 years of post-release supervision. He will also be required to register as a sex offender, Katz said.

These comments are disappointing.

Honestly it’s so sad and embarrassing reading some of these comments. People seriously blame a 7 year old for not speaking. I mean obviously what do you expect? It was her first one-on-one experience with a man and to tell her family what he was doing to her must have been horrible. Trauma can be determined by so many other factors other than a “panicked fashion”, especially after and in the long-term. Y’all are speaking as if she were wanting this to happen to her. No one. I mean no one deserves to go through all this. I hope this girl can find peace and let go of this awful experience.

I would like to know why she didn’t tell her mother about the sexual abuse right away.He probably would have lied about it and it would have gotten worse anyway.I don’t know why the mother would have hired a guy to take care of a young girl or anyone else, before checking references.

Not only that

But for three years she went with him willingly. No behavior from her sparked anyone to investigate this at all.

Wow, bee

Are you really buzzing in my ear about good touches and bad touches??? Her mother didn’t tell her about what to do when she allowed him to pick her up and take her to his home for three years!!!

She said nothing.

That’s very odd that she didn’t say anything to anyone and didn’t act terrified whenever he came to pick her up.

Wonder why

Very funny of you to assume that. Let me just remind you again. She was a child being manipulated by what? a 30 year old man. You would have to be the victim to understand her pain.

Assume nothing.

It’s the truth. For the past ten or more years society has listened to pretty much everything a child says about any adult in their lives. Good or bad. She said nothing and gave no terrified indication that she was being mistreated by him. Which means that in the third grade she doesn’t know what good or bad touches.

“Assume nothing? It’s the truth”??? You’re basing a “truth” on one single article that doesn’t even have the full story of the child. This is why so many people (children, women, even men) end up saying nothing about their story, because of people like you!! You’re quick in assuming a truth you barely know of.

Actually there's another article initially reporting the incidents.

She went along with it because she had no idea he was doing anything wrong. She had no idea what a good touch is versus a bad touch. She never once reacted in a dreading or panicked fashion.

Fed up

I hope he serves every minute of his sentence and the other inmates make it a living hell for him. Pedophiles and groomers deserve to suffer.

Fed up- I bet you’re still not fed up enough demand justice for victims like Katie Johnson who alleges Trump and Jeffrey Epstein sexually and physically abused her under threats to physically harm her and her family while a 13-year-old minor from June–September 1994 Katie Johnson v. Donald J Trump and Jeffrey E Epstein (dismissed) Lawsuit by Jane Doe who alleges Trump and Epstein engaged in forcible rape, imprisonment and assault while she was 13-year-old minor and another 12-year-old girl in 1994 Jane Doe v. Donald Trump & Jeffrey E Epstein (dismissed by Doe).

Fed up you’re not fed up enough to vote for someone who has been accused of similar crimes on multiple occasions with a known child predator as co defendant. How about justice for Katie Johnson and the rest? Katie Johnson lawsuit alleges that Trump and Jeffrey Epstein sexually and physically abused her under threats to physically harm her and her family while a 13-year-old minor from June–September 1994 Katie Johnson v. Donald J Trump and Jeffrey E Epstein (dismissed) Lawsuit by Jane Doe which alleges Trump and Epstein engaged in forcible rape, imprisonment and assault while she was 13-year-old minor and another 12-year-old girl in 1994 Jane Doe v. City Council passes bill shifting broker fee burden to landlords, sparking backlash from real estate industry and key critics

Nov. 14, 2024 By Ethan Stark-Miller and QNS News Team

The New York City Council passed a landmark bill on Wednesday, aiming to relieve renters of paying hefty broker fees — a cost that will now fall on the party who hires the listing agent. Known as the FARE Act (Fairness in Apartment Rentals), the legislation passed with a veto-proof majority of 42-8, despite opposition from Republicans and conservative Democrats.
