A Corona man was sentenced to three years in prison Wednesday for fatally shoving his elderly landlord down a flight of stairs last year.
Alex Garces, 23, pushed 71-year-old Edgar Moncayo down the front steps of his Corona home on Jan. 12, 2020, following an argument over unpaid rent. The altercation was caught on video.
The force of the push sent Moncayo flying down the full flight of stairs, onto the sidewalk in front of the 102nd Street home. He can be seen landing on his head and laying still on the sidewalk before the video ends.
Moncayo was rushed to Elmhurst Hospital and died the following day.
Garces had initially claimed that Moncayo accidentally fell, but police were able to review the incident that was caught on tape.
He was indicted on charges of first- and second-degree manslaughter and second-degree assault in February 2020 and at the time faced up to 25 years in prison if convicted.
However, Garces took a plea deal in May, according to the New York Post. He pleaded guilty to one count of second-degree assault in exchange for a lighter sentence.
A judge sentenced him Wednesday to three years in prison, to be followed by three years’ post release supervision, according to the Queens District Attorney’s Office.
The victim’s family denounced the short sentence outside the court building, the Post reported.
However, Garces pleaded for their forgiveness during the sentencing and acknowledged the “irreparable damage” he caused, according to the newspaper.

This is terrible but a lesson for landlords it is against the law to force your way into a tenants apt even if they haven’t been paying rent you must get a court order for a Marshall to remove someone. it’s sad the landlord must have been so frustrated with the eviction Moratorium that he took the law into his own hands. that might be part of the DAs reasoning for the light sentence, not sure I agree, but damn so sad
Lucky number 7 -This happened way before and he “eviction moratorium”. The moratorium was put in place since April 17, 2020.
let us guess, you’er fox informed- I dont know why you have to get so dismissive of people but thats your issues. I’ve work in the realestate bussiness for over twenty years and I can tell you that the courts in Jamaica were closed and not evicting people. Also the federal government with the passage of the cares act instituted the moratorium from March then the cdc issued it’s own moratorium and then states had their own as well.

the problem isn’t that we need more cops. The problem is we have terrible DAs and we need a mayor to appoint judges that will also enforce the law. end bail reform. we need law and order.
First-degree manslaughter’s eligibility for bail has not changed. WOW you’re completely out of the loop ? You accidentally proved how bail reform did not increase crime in this case.
I know bail reform does not apply to manslaughter. I was speaking about tightening up law and order all together. did you know that thug who killed that mother of two in the woodside houses as she went to run an errand for her family was let out of jail ( bail reform) three times on gun charges before he finally killed someone. yeah the system failed that family and all of us big time.

Landlords should write letters to communicate with tenants. People are stressed due to the pandemic.

3 years for killing someone??!! That’s outrageous, he took a life.
considering how dumblasio is releasing killers the next day, this is not shocking anymore. there is no justice.
I wish this could be an example of the need for conflict resolution skills and how a split second can change the course of your life and others. I know he was remorseful and instantly regretted it but 3 years is way too little time. The victim does not look elderly either despite his age.
